To whom it may concern,
Labuan FSA wishes to notify that it had filed a Writ of Summons and Statement of Claim against all of the Defendants at the High Court of Sabah and Sarawak, in the Federal Territory of Labuan for, inter alia, the following orders:-
(a) That the Defendants, their servants and/or their agents be restrained by an injunction from carrying on or transacting or holding any of the Defendants out as carrying on or transacting any trust company business, including, inter alia, the following:-
Labuan FSA wishes to notify that it had filed a Writ of Summons and Statement of Claim against all of the Defendants at the High Court of Sabah and Sarawak, in the Federal Territory of Labuan for, inter alia, the following orders:-
(a) That the Defendants, their servants and/or their agents be restrained by an injunction from carrying on or transacting or holding any of the Defendants out as carrying on or transacting any trust company business, including, inter alia, the following:-
- Providing management and/or accounting services to Labuan companies;
- Providing secretarial services to Labuan companies;
- Providing directorial services to Labuan companies;
- Providing registered office services to Labuan companies;
- Providing services to incorporate or register companies under the Labuan Companies Act 1990 (LCA); and
- Preparing and lodging, and/or acting as a lodging agent for, documents that are required to be lodged under the LCA.
(b) The 1st to 7th Defendants, their servants and/or their agents be restrained by an injunction from carrying on any business or in any way deal with the assets of the 1st to 7th Defendants (in particular, the 7th Defendant’s property held under PN 9870, Lot 205007807, Kampung Sungai Lada, Wilayah Persekutuan Labuan), or acting in any way with respect to the affairs of the 1st to 7th Defendants.
Please take note that the Labuan High Court had, on 10 October 2017, entered judgment against the 1st to 6th Defendants and subsequently against the 7th Defendant on 10 January 2018 in respect of, amongst others, the Plaintiff’s prayers above.
Therefore and pursuant to the above Judgments, the 1st to the 7th Defendants are restrained by an injunction from carrying on or transacting or holding any of the Defendants out as carrying on or transacting any trust company business, including, inter alia, the following:-
Please take note that the Labuan High Court had, on 10 October 2017, entered judgment against the 1st to 6th Defendants and subsequently against the 7th Defendant on 10 January 2018 in respect of, amongst others, the Plaintiff’s prayers above.
Therefore and pursuant to the above Judgments, the 1st to the 7th Defendants are restrained by an injunction from carrying on or transacting or holding any of the Defendants out as carrying on or transacting any trust company business, including, inter alia, the following:-
- Providing management and/or accounting services to Labuan companies;
- Providing secretarial services to Labuan companies;
- Providing directorial services to Labuan companies;
- Providing registered office services to Labuan companies;
- Providing services to incorporate or register companies under the Labuan Companies Act 1990; and
- Preparing and lodging, and/or acting as a lodging agent for, documents that are required to be lodged under the LCA.
Further, based on the High Court Judgments above, the 1st to 7th Defendants, their servants and/or their agents are also restrained by an injunction from carrying on any business or in any way deal with the assets of the 1st to 7th Defendants (in particular, the 7th Defendant’s property held under PN 9870, Lot 205007807, Kampung Sungai Lada, Wilayah Persekutuan Labuan), or acting in any way with respect to the affairs of the 1st to 7th Defendants.
Take further notice that the above named 1st to 7th Defendants had been duly struck off from the register of Labuan companies as follows:-
